About the Purpose of the Website

We focus on delivering fast and affordable websites using templates and design tools that simplify the development process.

  • Process: We develop WordPress, CCS, and HTML platforms to create websites quickly and at low cost. We focus on small businesses or entrepreneurs with limited budgets.
  • Revenue: Fixed prices or low service fees. This is supported by a basic plan and additional costs for customization or maintenance.
  • Advantages: We support clients who need fast and affordable solutions.

 

2. Custom Web Development (Custom Project)
We offer a service to develop fully customized websites, tailored to the client’s specific needs.

  • Process: We analyze the client’s requirements, develop a customized solution integrating design, functionality, and features, and then develop the website and then deploy it.
  • Revenue: Pricing is typically a fixed fee per project, which may vary depending on the complexity of the website or changes suggested by the client.
  • Advantages: We offer unique solutions | The project cost remains the same for each plan selected | We manage prototype design based on the client’s website objective.

 

3. Template or Theme Development.
This involves creating templates or themes for content management systems (CMS) such as WordPress, CCS, or Shopify, or e-commerce. These are then sold on theme marketplaces.

  • Process: We design and develop generic but high-quality templates for specific niches, industries, or purposes such as online stores, blogs, corporate sites, among others.
  • Revenue: Templates can be native WordPress themes, HTML programming code, stylesheets, or directly from the developer’s own website. There may be recurring revenue from updates or additional support.
  • Advantages: Passive income once the product is finished | Large market potential and expansion | Direct link to conversions on social media and similar platforms.

 

4.- Web Maintenance.
Includes website development and also focuses on recurring services, such as maintenance, updates, and ongoing support.

  • Process: After the website launch, the client pays a monthly or annual fee for maintenance services, content updates, SEO optimization, security management, among others.
  • Revenue: Recurring revenue is generated from maintenance and update contracts.
  • Advantages: Stable and predictable revenue | Ongoing relationship with the service provider | Feedback on ideas and new proposals | Prediction of anticipated changes.

About the Terms and Conditions for the development of websites

1. Acceptance of Terms

By engaging our services for website development, the client agrees to these Terms and Conditions. These terms will be binding and applicable throughout the duration of the contract and any future business relationship between the parties.

 

2. Services Offered

We undertake to develop a website according to the requirements specified by the client in the services contract. Services include, but are not limited to:

  • Website design and development.
  • Development of specific agreed-upon functionalities.
  • Implementation of client-provided content.
  • Basic training for website use (if agreed upon).
  • Limited post-launch technical support (as indicated).

 

3. Client Responsibilities

The client agrees to:

  • Provide all information, content, images, and materials necessary for website development within a reasonable timeframe.
  • Approving the design, development, and any other relevant aspects of the project within the established deadlines.
  • Ensure that all content provided does not infringe the intellectual property rights of third parties.

 

4. Website Ownership

  • The client will own all rights to the completed website, including the files, images, and other materials provided.
  • Intellectual property related to website development (code, design, custom functionality) will remain with [TryTopWeb], unless otherwise agreed.

 

5. Pricing and Payment

  • Prices for website development will be established in the service agreement and selected plan.
  • Payment must be made according to the agreed terms: generally a 50% down payment at the start of the project and the remaining 50% balance upon website completion.
  • Payments are non-refundable once work has begun.

 

6. Delivery Times

The estimated project delivery time will be determined at the start of the project, but may vary depending on the client’s requirements and any changes or delays in the delivery of materials or client approvals.

 

7. Changes and Modifications

  • Changes requested by the client after the contract has been signed may be subject to additional charges, depending on the time and resources required.
  • Any major changes to the project scope will be addressed through a new quote and agreement.

 

8. Warranties

  • We guarantee that the website will function according to the specifications agreed upon in the contract.
  • We do not guarantee that the website will be error-free or bug-free, but we will offer support and bug fixes for a specified period of time after project delivery.
  • We are not responsible for data loss, damage, performance failures, or issues arising from circumstances beyond our control (such as server or third-party issues).
  • After launch, the client will have 15 business days to report errors or fixes to the completed development.

 

9. Post-Development Support:

Support and maintenance of the website, once delivered, will be provided according to the agreed terms. If a maintenance plan has not been agreed upon, additional support will be billed at an hourly rate.

 

10. Confidentiality

Both parties agree to maintain the confidentiality of the information obtained during the development of the website. Neither party will disclose such information to a third party without the prior written consent of the other party.

 

11. Termination of the Contract

Either party may terminate the contract if the other party fails to meet its payment obligations or comply with the agreed terms. In the event of early termination, the client will pay for the work performed up to the cancellation date.

 

12. Disclaimer of Liability

We will not be liable for lost income, lost profits, or indirect damages resulting from the use or inability to use the developed website.

 

13. Applicable Law and Jurisdiction

This contract shall be governed by the laws of the country or region of (United States, Spain, and Chile). In the event of a dispute, the parties submit to the jurisdiction of the competent courts of (City/Province).
